AGREEMENT-OFFER FOR PROVISION OF SERVICES FOR INDIVIDUALS

St. Petersburg, 2022

This offer agreement is an offer to individuals not registered as individual entrepreneurs (public offer) by Anastasia Sergeyevna Schukina, hereinafter referred to as the Contractor, and contains all the essential terms of the service agreement. In accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation, if the conditions set forth below are accepted, the person accepting this offer becomes the Customer (in accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, the acceptance of an offer is tantamount to concluding an agreement on the conditions set forth in offer).

Please read the text of this public offer carefully. If you do not agree with any clause of the offer, we suggest that you refuse to use the services.

1. Definitions
Customer - an individual purchasing Services from the Contractor.
Contractor - Schukina Anastasia Sergeevna
Contractor's website - the website is hosted at https://www.sonostemporis.ru
Event - competition, festival, seminar, master class, etc. under the names published on the website at https://www.sonostemporis.ru and listed in Appendix No. 1 to this agreement
Regulations - the rules for holding a specific Event from those listed in Appendix No. 1 to this agreement. The provisions of the event are published on the website: https://www.sonostemporis.ru
Schedule of the event - the schedule of the Event by date and time
Organizer - organizer of the Event in accordance with the Regulations
Application - a message sent by the Customer to the Contractor in the form on the website or by e-mail: (Appendix No. 1 to the Regulations for the event).
Participant - an individual declared by the Customer to participate in the Event
Services - providing the opportunity to participate in events (competitions, festivals, seminars, master classes, etc.) in person or in absentia (remotely, by posting videos and the Internet) that are published on the site.
Offer acceptance - full and unconditional acceptance of the offer by paying by the Customer the cost of the Contractor's services in full.
Place of service - St. Petersburg, Russia

2. Subject of the contract
2.1. The Contractor undertakes to provide the Customer with Services in accordance with the terms of this agreement for the participation of the Participants declared in the Application in the Customer selected one Event from the list of events in Appendix No. 1 to this agreement in accordance with the Regulations for this event. Participants and the Event are determined by the Customer in the Application independently.

3. Procedure for accepting an application and accepting an offer
3.1. Acceptance of the application is regulated in the Regulations for the event. The Contractor sends a response letter to the Customer confirming the registration of the application and payment. Payment by details confirms the acceptance of the offer and the signing by the Customer of the Agreement with the Contractor, and full agreement with its terms, and also confirms the full consent of the Customer with the Regulations for the event.
3.2 After payment for the services by the Customer, the Contractor provides the Customer with information on the participation of the declared participants in the event: - Schedule of the event (general schedule) no later than 7 days before the event - The sequence of performances of the participants - no later than 7 days before the event

4. Rules for the provision of services
4.1. Services under the Agreement are provided within the time period specified in the Regulations on the event, and the day of the performance of the declared participant or participants at the event ends. Services under the Agreement are provided in accordance with the Regulations on the event.
4.2. When providing services, the Contractor has the right, in a justified case, to unilaterally change the terms for the provision of services specified in the Regulations for the event. In the case of a change in the terms of the provision of services, the Contractor must notify the Customer by e-mail or by phone.

5. Obligations and rights of the Contractor and the Customer
5.1. The contractor is obliged:
5.1.1. Provide the services provided for by this Agreement and its Annexes in accordance with the Regulations on the event in a timely manner, efficiently and in full.
5.1.2. Provide information on participation in the event. Information is sent to participants by e-mail, and at the discretion of the organizer is published on the organizer's website.
5.1.3. The Contractor undertakes to ensure non-disclosure of confidential information received from the Customer.

5.2. The Contractor has the right:
5.2.1 Independently determine the method of providing services and specialists providing services, in accordance with the legislation of the Russian Federation, as well as the terms of the Agreement in accordance with the Regulations on the event.
5.2.2. The Contractor has the right to refuse to fulfill obligations under the contract if the Customer has not paid in full within the specified time for the Services on time.

5.3. Obligations of the Customer:
5.3.1. Notify the Contractor of any reasons for the absence of the Customer and Participants at the events no later than 10 days before the start of the event by e-mail at the address published on the website in the Contact section
5.3.2. In accordance with the terms of this Agreement, the Customer undertakes to take part in all the events provided for in his Application according to the Schedule of the event and ensure the participation of the declared Participants at the event in accordance with the Call and with the Regulations on the event.
5.3.3. If there are comments on the quality and volume of the services provided, send the Contractor a written substantiated claim within 1 working day from the end of the provision of services according to the Schedule of the event to the relevant Regulations for the event. If the Customer does not send a written claim to the Contractor within the specified period, the services are considered to be rendered qualitatively and in full and accepted by the Customer without comment. Acts on the provision of services are not drawn up.

5.4. The Contractor is not responsible for:
5.4.1. Non-attendance by the Customer on events, for any reason, non-reading by the Customer of messages sent to the e-mail address specified in the application, late attendance the Customer or Participants to an event or performance, non-observance by the Customer or Participants of the rules specified in the Regulations for the event.
5.4.5. Failure to receive diplomas or prizes due to non-attendance at the awards ceremony.
5.4.6. For errors in the Application for participation in the event made by the Customer.

6. Copyrights and their transfer
6.1. At all events of the competition, the Organizer and the Performer make photo, video shooting and audio recording of the performances of the participants of the events. Presenting their performances, participants / their legal representatives give unconditional and free of charge consent to the Contractor and the Organizer for the publication of video shooting and audio recording of performances, their public display, broadcasting, or transmission in any other way, posting photos and videos of participants on the Internet, use in in print, in the media and in the mass media without the consent of the collective or individual performer or those depicted on them.

7. The term of the contract and the procedure for the return of funds
7.1. This Agreement comes into force from the moment of its Acceptance by the Customer and terminates after the Parties fulfill their mutual obligations - on the day of participation of the Customer or declared Participants in the Event.
7.2. The Contractor has the right to amend the Agreement at any time by posting a new version of the Agreement on the Website. By publishing on the Site, the new version of the Agreement comes into force.
7.3. In case of refusal to participate in the Event for any reason, the fee is not refundable.
7.4. In case of non-fulfillment by the Customer of the requirements in accordance with paragraph 5.3.1. and 5.3.2. of this Agreement, the funds are not returned, and the services are considered rendered in full. Exception in clause 8.2 of this Agreement, upon written request of the Customer.

8. Force majeure circumstances
8.1. Force majeure circumstances, recognized as such by the legislation of the Russian Federation, release both parties from liability.
8.2. The party referring to force majeure circumstances is obliged to immediately inform the other party of the occurrence of such circumstances in writing by e-mail. If the circumstances continue until the start date of the event inclusive, the contract is considered terminated and the paid fee is returned to the Customer in full.

9. Rules for the exchange of information and documents
9.1. The main communication channel is the Contractor's and Customer's e-mail. The Customer's e-mail is indicated in the application by the Customer.

10. Other terms
10.1. In this agreement, the mutual relations of the parties not stipulated are governed by the current legislation of the Russian Federation.
10.2. All disputes arising from the execution or termination of this Agreement are resolved at the beginning through negotiations. If it did not come to a settlement through negotiations in a court on the territory of the Russian Federation, at the location of the Contractor.
